Service Agreement

Prior to completing the online sign up form, please read the following terms and conditions:

The policies and guidelines expressed herein the Service Agreement between Innovative Web Communications and the Customer.

1. Innovative Web Communications will provide the services as outlined on this web site for each type of account.

2. Customer will create, maintain, and update all web content unless separate arrangements have been made with Innovative Web Communications or its affiliates.

3. Innovative Web Communications will provide basic CGI scripts for counters, guestbooks, and email as well as selected images that may be used by customers for their own implementation and use at no additional charge.

4. Customers are encouraged to use telnet or ftp protocols for updating their pages. Dial up access is provided at an additional charge of $.10 per minute. Four dialup telephone lines are available for customer use. Innovative Web Communications does not guarantee availability of such lines.

5. Idle logins greater than thirty minutes will be disconnected without warning.

6. Customer will not use copyrighted web content, images, scripts, or other information without the express written consent of the original author. The only exception is material included in the Customer Resource Center which is provided at no additional charge for the exclusive use of Innovative Web Communications' customers. Innovative Web Communications and/or Innovative Web Creations will retain all copyright to such images. These images are not to be distributed or included in any public image collections.

7. Customer will not distribute pirated software via the ftp site.

8. Customer will comply with all applicable federal, state, and local laws regarding copyrights, trade secrets, proprietary information, and other intellectual property rights, libel or defamation of character, invasion of privacy, etc.. For the purposes of this contract, the laws in effect are those in Howard County, Maryland, U.S.A.

9. Customer will protect the security of it's own account, as well as the security of the Innovative Web Communications server. Passwords and user ID's will be treated as private and confidential and not disclosed to third parties. Suspected violations of security will result in immediate termination of the account, billing for charges incurred to re-secure the server, and the user will be prosecuted to the full extent of the law.

10. Billing is done on a quarterly, semi-annual, or annual basis. Accounts set up between the first and fifteenth of the month will be charged starting with the first of that month. Accounts set up between the sixteenth and the end of the month will be charged starting with the first of the following month. Accounts will be suspended for non-payment on the tenth of the month. Customer is responsible for all charges incurred during the suspension.
11. Payment may be made via Visa, MasterCard, American Express, or Discover Card. Payment may also be made via personal or corporate check, or by money order. All checks and money orders must be in U.S. funds. Corporate purchase orders will be accepted at the discretion of the Innovative Web Communications accounting department and may require a credit application. Checks returned from the bank (ie, insufficient funds) will be assessed a $25.00 handling fee by Innovative Web Communications.

12. Innovative Web Communications endeavors to maintain all servers and internet connections available twenty-four hours a day. However, server maintenance may necessitate a period of down time and will not result in any refunds or compensation to the customer. Likewise, Innovative Web Communications is not responsible for down time as a result of the local telco or internet connection and no refunds or compensation will be provided to the customer. Innovative Web Communications is not responsible for any damage done to customer files due to hard drive failure, power surges, or other such occurrances. Customers are encouraged to maintain backup copies of their web pages on their own computers.

13. Although Innovative Web Communications will not censor information distributed via it's web server, it will comply within all legal capacities with local, state, and federal investigations in the areas of pornography, copyright violation, and software piracy.

14. Setup fees are a one-time charge and are not refundable upon termination of the account.

15. Early termination of the account by the customer will not result in any refunds.

16. Innovative Web Communications reserves the right to terminate any account for non-payment, illegal activities, and other violations of this contract. Such termination will not result in any refunds to the customer.

17. All rate and policies are subject to change at any time. Customers will be given a thirty days notice of any rate changes. Customers who have prepaid annual contracts will maintain the original price though the end of the year. Policy changes take effect upon announcement. Announcement of such changes will be done by email and be posted on the web site.

18. Virtual domain names must be registered with the Internic. Innovative Web Communications will glady process the registration. However, the customer is responsible for all Internic fees (currently $100 for the first two years, and then $50 per year thereafter). Internic billing will be done by the Internic and not by Innovative Web Communications.
